The world today is faced with a dangerous manifestation of recent history known as fascism. Opinions vary as to whether this movement is economic, social, political, or philosophical, but there is marked agreement as to its objective characteristics. Briefly, fascism means the seizure and control of the economic, social, political, and cultural life of the state by a small group. Free speech, free press, free worship, and public meetings are ruthlessly suppressed. Blind obedience to the "leader" is demanded of the people and the slightest wavering means death or imprisonment to any person. Restrictive policies may be carried on against his entire family. A fascist regime is necessarily militaristic and nationalistic.

It is not my purpose to attempt a technical definition of fascism, which is given in the preface, but rather to point to some of the tendencies prevalent in society today which might lead to a resurgence of this hated movement.

To most Americans the threat of fascism vanished with the defeat of Germany and Japan in the greatest war that history has known. There is, however, a real question as to whether we defeated the evil itself in destroying its two principal exponents. Public opinion appears in general to hold that fascism is a wholly European, or at least a wholly foreign movement. Yet there are many strong symptoms of fascism in our own democratic society. True, this movement in the United States masquerades under other names than the discredited one of fascism, but whatever it may be called, it's peculiar characteristics are alarmingly evident.

If we are to combat successfully such an insidious movement, many Americans must understand clearly what fascism is and what it means to the individual to live in a fascist state. At my request, the Legislative Reference Service of the Library of Congress has prepared a study of Fascism in Action as an aid to the American citizen in protecting himself and his children against this most dangerous movement of modern times.

A careful reading of this study will show what fascism in actual operation means in direct personal terms. Every person must think and act at the command of a higher authority. Every school, church, home, and business is carefully controlled by the dominant party. The concentration camp or death await the citizen who offers opposition to the regime.

To many, fascism, particularly as it operated in Germany, seemed a model of order and efficiency. It had apparently solved many of the most crucial problems of modern times. Fascist countries radically reduced or abolished unemployment, seemingly eliminated many social differences, and contrived many new devices which assisted or amused their people. But the cost to the individual was heavy. The price was abolition of representative government, of individual liberty, of the rights of free speech, free assembly, free religion, a free press, and the principle of equality before the law.

Fascist Germany and Japan used the boasted efficiency of fascism to build mighty war machines to crush the "inefficient" democracies, but an important fact had been left out of their leaders' calculations. Democracy and efficiency, even military efficiency, are not incompatible, and the democracies decisively defeated the fascist powers and coincidentally answered one of the principal arguments in defense of fascism.

I believe we are forced to admit that fascism is today an ever-present danger to our democracy. We must consider not only how to recognize its manifestations but also what we can do to combat it. Many means can be used but no one method seems to be the real solution. Some of the most effective are described briefly below.

Perhaps the best means of fighting fascism is to recognize it, no matter under what title it masquerades. Not all hate organizations are necessarily fascist, but they have certain definite trends towards such a policy. If members of groups of this type can be made to realize the dangers inherent in such beliefs, a long step toward overcoming fascism will have been taken. ---

One of the most powerful means of preventing the establishment of a fascist government in a democratic country is to make certain that the existing government operates honestly and efficiently No really strong democracy has fallen before fascism. Democracy is not to be had for the wishing, and the best efforts of every American citizen should be devoted to its perpetuation and successful operation. Democracy and efficiency are compatible, but insinuations that we must choose between democratic participation in government and efficient government often emanate from fascist sources.

PREFACE

This study of Fascism in Action was undertaken at the request of Representative Wright Patman, of Texas, who also indicated that its scope and method were to conform in general to the earlier study, Communism in Action --- prepared at the instance of Representative Everett Dirksen, of Illinois.

This study is appropriate because of the many similarities between fascism and communism, some of which Representative Fred E. Busbey, of Illinois has recently listed as follows:

1. The wiping out of all independent trade-Unionism with the result that those trade-unions which are permitted, exist only under the tolerance of the totalitarian state, to serve as its servile adjuncts.

2. The elimination of political parties except the ruling Nazi, Fascist, or Communist Party.

3. The subordination of all economic and social life to the strict control of the ruling, single-party bureaucracy.

4. The suppression of individual initiative, and the liquidation of the system of free enterprise, and a tendency toward government control of supercartels.

5. The abolition of the right to freedom of speech, assembly, and religious worship.

6. The reduction of wages and, in the case of communism, living standards.

7. The use of slave labor on a vast scale and the establishment of concentration camps.

8. The abolition of the right to trial by jury, habeas corpus, the right to independent defense counsel, and the innocence of the defendant until proven guilty.

9. The glorification of a single Leader, Fuehrer, or Duce, who is all-powerful and subject neither to criticism nor removal through the ballot.

10. The utilization of a special form of social demagogy - for example, incitement of race against race and class against class - the elimination of all opposition, and the concentration of power into the hands of the ruling dictatorship.

11. The subordination of all economic and social life and the everyday needs of the population to the requirements of an expanding military machine seeking world conquest.

12. The establishment of a system of nation-wide espionage to which the entire population is subject.

13. The severance of social, cultural, and economic contact between the people of the totalitarian state and those of other countries, through a rigorous press and radio censorship, travel restrictions, etc.

14. The open disregard for the rights of other nations and the sanctity of treaties.

15. The maintenance and encouragement of fifth columns abroad.

16. The reduction of parliamentary bodies to a rubber-stamp status automatically approving all decisions of the one-party dictatorship and the omnipotent Leader.

COMMENTS:

Am I the only one who sees far too many similarities between the path we are currently on and the one which is referenced above?

Note the highlighted words.

They are highlighted because you can read about them almost any day in our newspapers and magazines, or watch them on your television sets, or websites, as exponents of these patently neo-fascist policies can be heard to shout out as they stand in front of numerous flags and tell you how they are "christians" or "jews" (or "scientists" i.e. technocrats, by which they mean atheists pretending to be unbiased persons, above it all).

Whatever it is which they truly are, NEO-FASCIST cannot help to come to my mind, especially after reading the prescient warnings from the year 1947, two years after the end of WWII.

Wake up, already !!

And prepare yourselves for more to come.

This probably will not be a pretty sight to behold.

Just go ask Bradley Manning, or Edward Snowden, or the persons being held indefinitely, without legal rights, at Guantanamo, and Abu Ghraib, and Bagram Air Base, or those persons whom our great Leader determines should be assassinated without right to due process, or right to counsel and trial by jury.

This is a most definite and very ominous pattern.

These sound far more like the acts of enemies of our Constitution (which they have sworn to uphold, as the "law of the land"), than they do pro-Americans, like Representative Wright Patman.

Oh, and don't forget the supercartels = banksters = too big to fail? or too big to survive without massive government assistance, which you and I are paying for with our very life blood, no less.

I sure do wish you all would come out of your stupor before the final pieces of the "hangman's gallows" have been fully put in place, as is happening while we watch.

I especially like the language about a national surveillance system ("nation-wide espionage to which the entire population is subject"),
in light of the recent NSA/Yahoo/Microsoft/Google/Facebook/PRISM revelations.

Are there "snakes in the grass"?

Just how much evidence do you need, anyway?

This seems a pretty compelling case to me.

And I say that as one who has defended numerous criminal cases during nearly twenty-three years of trial practice.

Meaning, thereby, that I do know, all too well, whereof I am speaking, having long been in the practice of determining whether or not a constitutional issue will stand up to legal and factual scrutiny in a court of law.

This song,
070813a,
was written
at 3:30 this morning.

It is in a choral hymn style.

Was supposed to start in key of G major,
but I started in G minor,
instead,
and then drifted into G major,
and then went through
a number of related keys.

The style is reminiscent of
first year harmony class.

This is on purpose.

It is a sort of revisit
to what one is supposed to be learning.

Does anyone out there remember
Bach Reimenschneider?

It is a book of choral pieces
which were arranged by J.S. Bach,
for pedagogical reasons,
and then edited and published
by Reimenschneider.

It is intended, modernly,
to be used as a sort of bible
for this particular style of writing
(4 part chorale writing)
which lays the foundation
for all which follows.

Every once in awhile
I get in the mood
to go back to my roots.

Notice the numerous shifting modulations
and false cadences.

These are typical
of this particular style of writing.

I am just having fun with it,
because I can.

Hope you enjoy.

I am starting to feel like
working on some more
electronic oriented music,
although one can hear
that my love of choral music
is not diminishing in the slightest.

(I should note
that this was not always the case,
but that is a story for another time;
for now suffice it to say
that I was trained
as an instrumentalist,
who couldn't imagine EVER
writing for choir;
it's funny how
these kinds of things
work out without
our ever expecting it)

In this vein,
I think I will fire up
one of the other keyboards
and see where that leads.

But, that is for another time and date.

since I have composed.

It feels good to write.

7-5-13 (2nd post) SOME EXPLANATORY NOTES

It is 10:48 p.m.

I just got back to the computer.

As I was thinking about
the last post
I realized that it seemed
rather incomplete.

Almost like hearing
only one side of
a telephone conversation.

Because I have a number
of persons who have acted as
"sounding boards"
over the years,
I am used to having them
already know all of the details
about which I am writing,
as we work out finer levels of detail.

I would like,
first of all,
to tell the purpose
of some of these writings.

I have been writing
about politics and religion
(taboo subjects in the house I grew up in)
and philosophy,
and economics
since I was about 16 years old.

I have written regularly
during those entire 44 years
between now and then.

So that,
upon making my own website
about two years ago, now,
it was only natural for me
to write on it.

I know that many persons
consider my thinking
to be rather radical
or scary
or offensive,
such that I have taken
a long time
to really start writing
what I think in these fields
other than music
and it's related subjects.

But, as I have said,
things have just gotten weirder
and weirder
since the infamous 9-11 incident,
which looks very much like a coup d'etat,
and that all the moreso
as time goes on
and we continue to hear
the obscene thoughts
of all of these
merchants of war and death
who want to make their
disgustingly homicidal behaviors
have a veneer of justice
and religion
and Americanism,
when such is, in reality,
sorely lacking.

One of the questions that myself,
and others like me,
asked for decades,
was how in the world
did the Germans capitulate
to the insanity of the Nazi party
and Hitlerianism.

I no longer ask that question,
as I have had it so fully answered
during these past 12 years.

So, now, the new question is,
are these people as insane
as they appear to be,
and why so many of them,
all at once.

This is where the study of psychopathy
and the even more recent studies
of neurogenesis and neuroplasticity
come into play.

Many of us have discussed
and asked the question
numerous times
as to why it is
that the longer that people
are in politics
the worse they lie
while exponentially increasing their bloodlust,
which seems,
much of the time,
to be insatiable.

One cannot but help be reminded
of the interview with Ted Bundy,
serial killer,
in which he explained
the process that went on
inside of him
as he degenerated from nice man
into homicidal maniac.

One can't help but wonder,
after watching those interviews,
if the same process
is not taking place
in numerous others.

Or, how does a Sadam Hussein
or an Adolf Hitler,
or Joseph Stalin
become so paranoid
that they begin to murder
the people who helped
put them in power,
now deciding that their lifelong friends
are actually their mortal enemies.

And what exactly is it
that causes so many politicians
to become pathological liars,
to the point where
it becomes embarrasssing
to watch and/or listen to.

So much so,
that I finally was forced
to pull the plug
on my television set
ten years ago,
and never plug it back in.

And being really glad
that I did so,
especially when I am forced
to watch one
at other people's houses
or in public venues.

It is nothing but mental rot,
so far as I am concerned,
and cannot be good
for anyone
who is going to feed
on a steady diet
of the garbage,
and hysteria,
and paranoia,
and fear mongering.

I worked in places
which I refer to as "war zones",
where death and destruction
are rampant
on every side of you.

I certainly have no need
to have some grotesque
presstitution service
try to titillate me
with their latest
vicarious Roman colosseum.

I find it utterly repulsive and disgusting.

You can only imagine
how difficult it is for me
to relate to all of those
who are feasting regularly
on this garbagefest.

So, it is in this context
that I try to find out
all that I can about
what the latest real science
is showing us
about the inner workings
of the mind.

And, it is, indeed,
shocking to behold.

This is because,
as I have mentioned before,
we are learning
that the brain is making new tissue
with every lie that is told.

With every wicked imagining,
a new layer of tissue is formed,
until the layers become so thick
that they are able to
take on a life of their own,
as fantasy begins
to turn into compulsive behavior.

Yes, out of the heart come the issues of life.

Your thought life really does matter.

And it WILL be reflected
in your persona,
one way or another.

So that the politicians
with their constant lying
become ridiculous to listen to
over time,
as they continue to believe
that we are all as stupid as ever,
and will repeat whatever they tell us.

But, instead,
it seems to be part of their judgment,
that anyone with
an open ear,
open eyes,
and an open mind
can only continue
to be shocked
at the degeneration
that takes place
right before your eyes.

I always like to say

that the best argument for term limits
is to watch the people
who have been in political office
for a long time.

They start with some shady backroom deal,
which is then followed by another,
and then another,
until they are certain
that this is just how the world is.

They have no idea
the change that is taking place,
for all to see,
even if they don't want to admit
just exactly what it is
that they ARE seeing.

I have watched this
for many years
as our entire country
has degenerated more and more
until one can only shudder
to think where this is headed.

And that is where
my studies of psychopathy
and sociopathy
and neurogenesis
and neuorplasticity
come into play.

We have reached a point
where we can actually
"photograph"
the changes
as they take place.

And those "photos"
are very scary to look at.

And the implications of them
are very scary to think about.

We are at a dividing line.

My recommendation
is to watch your thought life
even more closely
than you watch your outward life
which you are trying to project
onto the world about you.

So, with these few brief comments,
I am going to wrap it up.

I have to go back
on the road tomorrow morning,
and do not expect
to be back online
until Monday evening,
or Tuesday.

In the meantime
I hope I have given
some food for thought.

Please do not judge me
too harshly
for being so frank
and forthright.

I started out life
as one who had little regard
for truth and property rights.

By the time I was a teenager
I had begun to feel the effects
of my wicked ways,
and swore off of them,
and decided to take
the very opposite course of
"truth at all costs".

I really do not care
what anyone thinks about this,
at a deeper level,
because I believe that truth,
and integrity,
like virtue itself,
are their own reward.

I am very glad
that I have taken the course
which I have.

It is true that
the truth will set you free.

But not without offending
numerous persons around you
who are all too wedded to the lie,
which seems invariably
to lead directly into psychopathy,
and from there to
a complete unraveling of the mind,
as up becomes down,
and in becomes out,
and black becomes white,
until one is simply forced
to shut up,
being afraid of
what other people will think.

That's not for me.

And I hope that
any who read this
and consider these matters
will join me in this opinion.

I am tired and
really must try
and get some rest.

I hope to write some more music soon.

In the meantime,

my focus is on learning to love the unloveable.

I am not very good at it.

But, I sure am trying.

I can say that with honesty and fidelity.

7-5-13 ARE MOST OF OUR POLITICIANS PSYCHOPATHS ??

I just finished reading
the new book,

Almost a Psychopath

by Ronald Schoutgen, MD
of Harvard Medical School,
and James Silver,
criminal prosecutor
and criminal defense attorney.

The subtitle on the cover
of the book reads:

Do I (or Someone I Know)
have a Problem with Manipulation
and Lack of Empathy?

So much of this book
cannot help but
continuously remind me
of the various persons
who one sees
day in and day out
in the mass media,
including the politicians
and their hacks,
sycophants,
and enablers.

It is a common problem
and I highly recommend this book
for the general reader
who would like to better understand
this subject.

I wanted to share several quotes
out of the book,
which I thought were
particularly interesting,
each for it's own specific reasons.

But, first,
I want to make clear
that when I use the words
sociopath
and
psychopath
in my writings,
that I am not intending
to use them
as diparaging remarks,
or such like.

Rather, I am speaking
as someone with a
medical and psych background
who has worked in both fields.

So, I am using these terms
in their most technical sense,
as used in the
medical and psychological literature
and in peer reviewed journals.

Accordingly my first quote
will be an attempt to,
somewhat loosely,
define the term psychopath
and
psychopathic personality disorder.

"A major advance
in the twentieth-century understanding
of psychopathic behavior
was the work of
American psychiatrist
and psychoanalyst
Hervey Cleckley.

Cleckley worked in
a psychiatric hospital
in Augusta, Georgia,
and in 1941 published his book

The Mask of Sanity;
An Attempt to Clarify
Some Issues
About the So-Called
Psychopathic Personality.

As the title of the book suggests,
Cleckley believed
that the psychopath hides
his or her lack of empathy
and moral constraint
behind a mask of
normal function
and seemingly appropriate behavior.

Cleckley proposed that
there were sixteen specific traits
associated with psychopathy,
including

superficial charm
and good intelligence,

unreliability,

untruthfulness,

lack of remorse and shame,

absence of delusions and anxiety,

an inability to learn from experience
or follow any life plan. ---" p. 31

The next quote concerns
why it seems that men
are far more prone to psychopathy
than are women.

The authors suggest
that this is a matter of
cultural bias
and misperception.

" --- And the types of aggressive behavior
that female psychopaths engage in
may differ somewhat
from the aggressive actions
of males:

females are less likely
than males
to use overt forms of aggression
(punching and kicking)
and more likely
to rely on covert forms of aggression
related to their social groups
(gossiping, ostracism -
which is sometimes called
relational aggression). p. 146

The authors remind us
that psychopaths are attracted
to certain professions

(like business and politics,
for example).

In this context,
they remark that:

The developer of the PCL-R himself,
Robert Hare,
has observed that
in addition to studying
psychopaths in prison,
he should have spent time
at the Stock Exchange
as well. p. 147

A peer reviewed article
was written in which the authors
compared the inmates
in a mental institution
with '"senior business managers"
from the world of business:

" --- In 2005,
two psychologists
at the University of Surrey, England,
published their research
comparing the personality profiles
of high-level British executives
("senior business managers")
with randomly selected
psychiatric patients
and criminal psychiatric patients
at Broadmoor Special Hospital,
a high-security hospital
in the United Kingdom
and home to some of Britain's
most notorious criminals. ---

--- For our purposes,
the most interesting results
of the study
came from the comparison
of the senior business executives
to the offenders at Broadmoor.

The study showed
that three
out of the eleven personality disorders
were more common
in the senior business managers
than in
the criminal psychiatric patients.

These were

histrionic personality disorder

(superficial charm,
insincerity,
manipulation),

narcissistic personality disorder

(grandiosity,
lack of empathy),

and

obsessive-compulsive personality disorder

(perfectionism,
excessive devotion to work,
rigidity,
dictatorial tendencies)

scales. ---

Not surprisingly,
the senior business managers
were less likely
to express physical aggression,
impulsivity,
and antisocial
and paranoid tendencies. ---" pgg. 148-150

I thought that the following
is a rather insightful quote,
worthy of consideration,
as it seems to be a problem
which one will run into
over and over again
as one tries to better understand
what is going on, here.

" --- It is a common human failing
that our capacity for objectivity
can be limited
when it comes to someone
who is benefiting us
or with whom
we are close. p. 150

Some insightful words on bullying,
which seems to have
become the hallmark
of Amerikan foreign policy,
having become institutionalized
in the belief systems
from which exceptionalism,
in all of it's ugly forms,
seems to arise from.

Think about beating up
on little countries that really
have no way to defend themselves,
or to fight back.

And think of those poor persons
at Guantanamo
who are being forced fed
so that tormentors may continue
to torment them.

If that is not bullyish behavior,
then what is?

" --- Like schoolyard bullying,
workplace bullying
is a pattern of behavior
where a person
(or group of persons)
engages in
persisent aggressive behavior
against a subordinate
or co-worker.

The key features of bullying

(as opposed to
isolated instances of bad behavior)

are that
it occurs regularly,
goes on for some time,
escalates over time,
and is based on
a "power disparity"
where the target
lacks the power
or means
to defend against the intimidation.

As with other types of harassment,

its goal is often
to send a message
to the victim
that he or she
does not belong there
and that continuation
in the workplace
is dependent upon
giving in to the demands
and control
of the bully/harasser. ---" p. 151

--- Perhaps these workplace bullies
act differently with their families
or in the neighborhood,
showing compassion
after five
and on the week-ends.

Not so with almost psychopaths
or true psychopaths.

They are unlikely
to change their stripes,
as it were,
when they leave the site or office -
either because they can't
or they see no reason to do so
unless it serves their interests
in an obvious
and immediate way.

No matter how charming
they seem in first encounters,
over time
they will show themselves
to be
cold-hearted
and manipulative,
whether you run into them
at a church social
or the grocery store.

Being an almost psychopath
isn't just a workplace strategy -
it's a way of life.

And a way of misery
for those whose lives
they touch. p. 153

Conclusion:

I will leave it to you,
dear reader,
to decide just how
applicable these thoughts are
to the politicians
and all of their
brotherhood/sisterhood enablers.

To my eye and mind,
it looks as if pychopaths
have risen to the top
in many political offices
and governmental positions,
due to their ruthlessness
and lack of conscience
and ability to lie without blushing.

These people are not just
rude,
ignorant,
and arrogant,
but DOWNRIGHT DANGEROUS!

Remember that the next time
you are listening to whatever
latest lie and/or misrepresentation
they are attempting to pawn off on you.

And notice how they never are the ones
who are paying the tab,
either with cash,
or with blood and treasure.

Win-win for them.

Lose-lose for you and me.

That hardly sounds like the stuff
of real and meaningful representative
government.

That is to say,
who would hire
a representative
to act entirely against
their own interests?

NO ONE ??

This system of
"creeping pathology"
seems to be just built
into the nature of things,
as the system exists in
it's present form.

Especially when Social Darwinism
is in vogue as it most certaintly is
at this time.

This can only spell disaster
for all concerned,
as I believe that it currently is doing,
and is about to do,
much more than many of you
are even capable
of suspecting
or imagining.

7-4-13 SO, WHAT IS "MOMMYISM", ANYWAY?

It is 4:40 a.m.

I cannot sleep, once again,
so that I have gotten up
to write a few words on
what I have come to term as
"Mommyism".

One of the best examples
I have ever seen
of such a thing
took place
on one of the first cruises
I ever went on.

I believe it was the very first one.

It was from Los Angeles,
to Ensenada, Mexico,
and back in five days,
with a stopover at Catalina Island,
and a quick swing through
the Channel Islands
off the coast
here where I live.

We got off at Ensenada,
and there it was.

A pharmacy,
right there on the dock.

And one could buy
all of the narcotics
which one could possibly
want or desire.

Lots of Vicodin,
and Oxycotin,
just like Aspirin
and other
over-the-counter drugs.

I looked around
to see all of the drug addicts
lining up to get their narcotics.

But, there were none.

I looked around
to see all of the people
laying in the gutter,
half out of their minds.

But, there were none.

Then I was forced to ask myself,
and to consider,
why is it that people
who are much less educated
than myself
and my fellow countrymen
are able to have
these drugs available,
but we are not?

Years later,
I was in Amsterdam
in the Netherlands.

There people could buy marijuana
and magic mushrooms
over the counter.

There were places
set up like bars,
where everyone
was smoking weed,
instead of drinking.

But, according to local statistics,
90% of sales
are to foreigners
who come there
for that very purpose,
alone.

I looked around,
once again,
to see the end of civilization
as we know it,
and saw instead,
nothing but very intelligent people
going about their business,
with 99.9% of them
plainly and obviously sober.

Yet, in my country
we are told all kinds of horror stories
about what would happen
if we had legalization
or de-criminalization.

This is "mommyism".

Mommy says
you cannot have this
or that,
because you are simply
not smart enough
or moral enough
to be able to handle
the consequences.

That is the message.

Only "mommy" knows
what is good for you
and what is bad for you.

You simply cannot be trusted
to make such decisions
of your own free will.

So, all of a sudden,
the state,
which is supposed to
stop crime and violence,
has instead,
become my mommy,
while being by far
the number one perpetrator
of violence and plunder/theft.

And we all know that
mommy knows best.

It is when the state
gets into attempting
to regulate morality
and thought,
in place of stopping violence
and theft,
that we get into
what is otherwise known as
"paternalism".

As in, the paternalistic state.

Every fascist dictatorship
and their various different offshoots
being very good examples
of this type of divisive
and degenerated
"thinking".

I put thinking in quotations marks,
because the very point of "mommyism"
is to not have to think.

In the final analysis
it is for the intellectually lazy,
who would rather be told
what to do
than to think for themselves.

Frederic Bastiat,
in his brilliant little booklet,
"The Law",
shows how this insidious process
is activated and energized
by "legal plunder"
and "false philanthropy".

The false philanthropy
generally being the excuse
for the legal plunder.

While the Soviet
and Chinese Communist
totalitarian police states
used to be the models
of such behavior,
our own country
has come a very long ways
into that camp,
such that the dictator
of modern day Russia,
Vladamir Putin,
can speak,
just several days ago,
of his "strategic partnership"
with these United States.

And the very unapologetic
Communist Chinese
have become
our largest trading partner.

Just as one can see
in George Orwell's
opening chapters
of his novel 1984,
either of these two parties
can one day be friends,
and the very next,
enemies of the most devious kind.

It just depends on how "mommy"
wants to play her cards that day.

Consistency is something
which has little or no relevance
when mommy decides to speak.

So, why mommy,
instead of daddy?

Because mommy wipes your butt,
and wipes your nose,
and dries up your tears
and tells you everything is o.k.,
even when it is not,
and you are,
in fact,
in great peril.

Mommy tells you
who you can date,
and who you can
have sex with
and in what manner,
and where,
and why.

When we were just kids,
during the 1960's,
we were told that the Communists
were our mortal enemies,
and that we had to give up
our liberties
and bank accounts
in order to fight this monster.

We fought the Vietnam War,
without anyone being able
to give a coherent answer
as to why we were there.

To contain Communism,
was the answer that mommy
always came up with.

Well, how did that work out.

They are still Communist.

But the world did not end
the way that mommy told us
it was going to.

That was at the height
of the Cold War.

With Russia having tens of thousands
of nuclear warheads
all targeted on the U.S.

This is why
none of us expected
to grow old before dying.

We were sure
we would be incinerated,
long before that.

So, you can only imagine
how strange it seems to me
to watch mommy cozy up
with the enemy,
to whom we shipped
all of our industrial base,
while our mommyistic politicians
told us what a good deal
we were getting.

We were going to be the brains,
and the Chinese would be the laborers.

It was the same with immigration.

We were told by the mommyistas
from both parties
that these people
were only taking the jobs
that no one else wanted.

It didn't take long
to figure out
that either mommy is
a big fat liar,
or else nobody wants any jobs,
as one after another
was taken over
by undocumented aliens
and their families
and friends.

Now,
in order to
complete the destruction,
we are supposed to take joy
in the fact that mommy
has decided
that it is in our best interests
to legalize all of the illegals,
instead of being honest
and stopping the damage
which has been done,
before it becomes even worse.

This is happening
while there are few or no jobs
to have,
as our country sinks
further and further
into institutionalized insolvency.

As I grew up
we fought the Korean War,
and then the Vietnam War.

These were followed by the
War on Poverty.

And then the
War on Drugs,
during which our 4th amendment
was systematically eviscerated
by the Supreme Court
of Justice Rehnquist
who found one exception
after another to the warrant requirements,
until the exceptions
were well said
to have swallowed up the rule.

The reasons?

Mommyism.

That is to say,
the drug war.

Now we have
our latest incarnation
of this same process.

It is now the
War on Terror.

What utter nonsense.

The so-called enemies
are fabricated
and financed
by our own mommyistic government.

And it is going
just the same way
as mommy's prior wars.

For, think about it
for just a moment.

Is North Korea still Communist,
and moreso than ever?

Is Vietnam still Communist,
and moreso than ever?

Did we get rid of poverty,
after spending much
of our entire substance
on the war against poverty?

No.

It could be argued,
instead,
that we are well on our way
to the greatest amount of poverty
this nation has ever seen.

Did the war on drugs
get rid of the drug trade?

No,
mommy has instead
empowered the drug lords,
such that they have so much money
that they were forced
to go "legit".

Yeah,
right into the banking business,
the insurance racket
(AIG, for example),
the stock exchange business,
and the housing market business.

And finally
into the government business.

Yes,
that is the real reason
behind NSA.

It is not to protect you
from anything.

It is the mob protection racket
in it's most sinister form,
and little else.

For if you have captured
all of the mail bags,
and all of the communications,
you can blackmail persons
to no end.

Yes,
you can make people
do your evil bidding.

Don't think that is what is going on?

Then you might
want to stop for a moment
and take a longer
and harder look.

You wonder
why the Republicant's
don't jump on the
Demogogueacrats
when the opportunity
is so ripe for it?

Not when certain people
have the goods on you.

Complete with dossiers
which would make
J. Edgar Hoover
envious,
with photos
and taped conversations
and intercepted communications.

This is why they are
recording everything.

It is in hopes of
finding something
which they can
use against you,
later on,
if you become
too much of a liability,
where mommy is concerned.

And it further
serves as a warning
not to get out of line.

Because remember
that night when you ---------?

Well, guess what?

We recorded the whole thing
and can replay it
at any time we want.

So, don't even think about
f***ing with us,
OR ELSE !!

It will be to the Gulag with you.

And that without
even the possibility
of judicial intervention.

Not that it would really matter,
anyway.

As we are now
in the world of Hitler's Justice,
in the place of Magna Carta
and the "rule of law".

As an example
of just how ridiculous
mommyism becomes,
with so little effort,
one only need
to read of the arguments
being put forth
by the federal government
in justification of
tube feeding
the hapless prisoners
at Guantanamo

(which Barry O.
promised would be closed
within one year,
for all of those of you
who can't remember
what mommy has told you).

The argument
being presented in court
is that
they would be taking part in a suicide
if they allowed the prisoners
to starve themselves to death.

And the numbers were astonishing.

It was over 3/4 of the inmates
who are so desparate
and despairing
that they are simply refusing to eat.

They would rather die
than live in the degrading conditions
in which they are being
forced to live,
with no ability
to seek any legal remedy,
as the "rule of law"
has apparently been
indefinitely suspended.

How could these psychopaths
care for even one moment
about whether these persons
are dead or alive.

Their actions
betray their motives
with a vengeance.

But now,
they put forth some of that
"false philanthropy"
made so famous by Bastiat.

It is only because
mommy is looking out
for her little children
that we are in court fighting
for the right to kill them
when we want to,
after torturing them for years,
and not one minute sooner.

But, mommy
is able to tell this
in an entirely distorted version
about how she is trying
to protect their souls
from eternal damnation,
because god forbid
that they should be allowed
to commit "suicide".

One cannot but be reminded
of the infamous Spanish Inquisition,
which was modeled
after the Papal Inquisition
(against the Cathars)
approximately 500 years earlier.

While it is really
all about power
and money,
mommy will never tell that.

Instead,
she is out to save the souls
of these recalcitrant heretics,
who just simply
do not know any better.

So, now,
in a complete inversion
of moral values,
we are to claim
that we are doing a favor
by torturing whoever we want,
when we want,
and how we want.

After all,
it is their eternal soul
which is a stake.

And thankfully,
mommy knows
just how to help you out
by burning you to death
at the stake.

Please DO NOT
do me any favors,
mommy.

Now,
here is
one of the ultimate ironies
of mommyism.

There is more violence
and theft than ever.

That is to say,
if the job of government
is to stop theft
and plunder
and violence,
but instead
they have become
the epitome of such things,
which are now
more in abundance
than ever,
does this not mean
that they are
a complete and utter failure?

It is like what happened
to the President of Bolivia
the day before yesterday,
as his plane was forced
to land in Vienna,
because France,
Spain,
and Portugal
would not allow him
to fly through their airspace.

Why?

Because the U.S.
had it "on good authority"
that Edward Snowden
was in that plane.

Or so it was claimed.

Of course,
he was not.

Which can only mean
one of two things.

Either,
first,
with all of that electronic spying apparatus,
they still cannot get it right,

or they are just acting
like the mommyistic monsters
which they truly are
and intending
to send out a message
to any would-be helpers
of one
who is lawfully seeking
political asylum.

It is the same with Guantanamo.

There is a very good reason
why it remains operational,
and it has nothing
to do with "terrorists"
or "terrorism".

It is, rather,
a warning to you and me.

If we piss these people off,
then we may very soon
find ourselves there,
in the very same predicament,
as we are force fed,
as our captors
pretend to have ultimate power
over life and death.

They do not
and, indeed,
cannot.

And have certainly
shown themselves
for the mobster bullies
which they most definitely are.

For,
in the final analysis,
mommyism has joined hands
with mobsterism,
while turning a blind eye
to all of the numerous crimes
which are being committed
in the furtherance
of turning the entire planet
into a Gulag,
with nowhere to run
or hide.

What a sick bunch
these people truly are.

Yes,
this is mommyism
come to it's ultimate conclusion.

Mommy hates her children,
as it turns out.

But, why should that surprise you?

Finally,
the worst part
in all of this
is who those persons are
who pretend to be looking out
for our best interests,
as our mommies.

The people to whom I refer
are moral degenerates.

They are clincally defined
as sociopaths
and psychopaths,
to a person,
the best I am able to tell.

So, to hear them moralizing
is just a bit much.

But, oh how they can moralize.

They can tell you
all about
just how screwed up
you are
and how lucky you are
to have them here
to protect you
from you.

To hear one ex-President
moralize
after only having been stopped
from the worst slander imaginable,
thanks to a real mom
saving the
blue sperm-covered dress,
really is just a bit much for me.

And to hear another moralize
after he has sold
all of our liberties
down the road
for a song and a dance;

And having created
a bunch of torture sites
and death camps
which would be the envy
of Hitler and Stalin and Mao,
is also just a bit much.

It really creeps me out
when these people
think to tell me
how I should live
and by what moral code
I must subscribe to.

I most definitely
DO NOT want
to be like them.

And I do not want
any of my children
or their friends,
or my friends
to be even
a little bit like them.

When these persons started,
a banker was considered
a pillar of the community
and a fount of financial wisdom.

Today,
we refer to them as "banksters"
because the shoe fits
only all too well.

The least trustworthy people
to give your money to,
for the most part,
as it is turning out.

Bankster,
as in huckster.

Politicians as in
clownism.

Liars
to a person.

And thinking
that this is not only
a requirement,
but
a moral imperative.

One can only wonder
where this is leading to,
or where it is
all too likely to end.

I sure wish people
would wake up.

Where is the outrage,
anyway?

When will our people
rise up in the millions
the way they did in Egypt
during this past week?

Only when it is too late?

And all is alreadly lost?

That is most assuredly
how it looks at this time,
as I can only hope
that I am wrong,
but never having been so
when it comes to these matters.

How many wake up calls
are required,
anyway?

There have been far too many,
already,
such that any intelligent
and observant person
must be in a
continuous state of despair
as he/she watches
his/her fellow humans
lining up for the slaughter
as if all is well,
while mommy tells them
not to worry,
because
mommy has it
all in control.

Happy 4th of July.

I can only imagine
our founding fathers
are turning over
in their graves
at what has become
of their once mighty nation
and belief systems.

From riches to rags.

And from enlightenment
to the most profound darkness
imaginable.

But, I am no doomsayer.

And I do believe
that the true gospel power
(as found in the red letters
in the NT)
will prevail,
in spite of
all of the phoney religions
and phoney politicians
and phoney moralists,
and pretended do-gooders.

I guess every so often
a bunch of us
just have to eat sh*t and die,
so that our blood may provide
fresh inspiration
for those who follow
who will be forced to say,
once more,
apparently,

NEVER AGAIN !!

I am told that
at some point
the swords will be beaten
into plowshares
and pruning hooks.

Just when,
I do not pretend to know.

But, I do know
that there is a higher being
and power
at work
throughout all of this.

And we have
yet to hear
from that person.

I suspect that the plans
of all of these
would-be oriental despots
and their ilk
will be quickly overthrown
with great violence.

It is just a matter of time,
if that is any consolation.

In the meantime,
we ALL must resist evil.

And there is most certainly
a lot of evil to resist
right now.

I guess we had better
get extra tough
if we expect
to make it
through the coming firestorm.

This is a very pithy satire
which demonstrates,
in a rather unique manner,
the shallowness,
insincerity,
and downright disingenuousness
of all of those do-gooders
who pretend to be
out to help you and me,

paying the very extravegant bill.

I read this essay at about
16 or 17 years of age,
and found it to be
life-changing,

today.

l was very fortunate
to get to meet with,
and spend an evening with
Gary Allen,
not long before he died.

He was one of the nicest,
and by appearance,
one of the most honest
men I have ever met.

His book is a MUST read
for anyone who
wants to understand
what the larger context is,

What is going on with NSA and
Snowden whistleblowing
is nothing new.

It is part of an ongoing continuum.

But, there is one HUGE difference !!

You can now see,

WITH CERTAINTY,

that when they called
the more astute observers

"conspiracy theorists",

and acted as if they were
delusional,

they could not have been
bigger liars,

or more offensive.

I thought I should briefly touch base.

All is well here
(except for my broken neck;
the cervical vertebrae
have been moving
all over the place
for past two weeks
= very uncomfortable,
but I am hoping that
they are realigning themselves properly,
following a whole series
of hits to my head,
each of which managed
to cause further compression injuries
= OUCH !!).

I have had no "inspiration"
to write music
since the untimely
and tragic
death
of my very good friend,
in spirt,
Michael Hastings.

One could say that
I have been in deep mourning.

That is probably
not far off the mark.

I have also been very busy
playing catch-up
with my own paid work.

Just for the record
I re-worked the June 14 post,
titled,

So, just what is "Clownism", anyway?

This is the one
which I had
a lot of problems with
getting it edited,
after adding a reference
to the very illuminating work
of Kevin R. Ryan.

I hope any who are interested
will take a look at it,
now that it has been edited.

It couldn't be more on point,
based upon what has transpired
since that date.

My personal favorite,
during these past weeks,
was Senator John McCain,
making a speech in Israel
a couple of days ago
in which he came right out
and argued for arming
the so-called Syrian rebels
with anti-aircraft guns
and shoulder launched missiles,
even though they may get
into the hands of Al Qaeda,
who just happen to be known
for liking to shoot those missiles
at passsenger airliners.

Small price to pay,
according to McCain.

After all, it is a win-win
for him
and his fellow delusional paranoids.

Much better than letting that arch-fiend,
Assad,
continue to peacefully govern
his highly pluralistic country,
as he had been doing up
until all of those
CIA and MI-6 sponsored attacks
upon a sovereign country
began and continued

(which were,
once again,
reported in the foreign press
from the very first day they started,
about two years ago,
but not in
the good ole US of A).

Unfortunately,
for him,
and his fellow countrymen,
Assad just happens to be in the way
of all of that nice yummy Caspian Sea oil.

Repeat after me:

"No blood for oil, here.
No siree.
We only want
to bring
Democra - seeee"

"What an incredible
and unbelievable waste
of both blood and treasure",
I can hear the inner historian
deep down within me
complaining very loudly.

It is 5:20 a.m.

The Sun is coming up
and the birds are all happily chirping
outside my window
as I write this.

I attended an all-day seminar
in Santa Barbara,
yesterday,
titled
"Understanding Energy and Fatigue:
Focus on Stress, Habits, and the Brain".

The speaker was William J. Sieber, Ph.D.,
an highly experienced psychologist
who comes from
the Department of Family
& Preventive Medicine,
Department of Psychiatry,
at the University of California,
San Diego.

The audience consisted of
medical professionals.

Once again,
we were learning
of the very latest
cutting edge science
in this field,
with a particular focus
on the cellular biology of fatigue,
psychoneuroimmunology,
role of inflammation,
outsmarting your "gut brain",
chronic fatigue syndrome,
and the physical effects of PTSD
and sustained stress/burnout,
among other topics.

Very interesting,
needless to say.

I learned the finer distinctions
between insomnia
and sleep deprivation,
and the causes and cures
of both.

So, wouldn't you know it,
I have been laying awake
all night,
thinking about a statement
which I read on my return trip home.

The whistleblower,
Edward Snowden,
had escaped from the clutches
of the U.S. military/industrial complex,
at least for the moment,
to Russia.

All waited to see
whether Vladimir Putin
would hand him over
to his would-be captors.

While returning to Ventura,
from Santa Barbara,
I was looking up a paper
written by Martin Seligman,
on learned helplessness,
which had been referenced
at the seminar.

I had read the paper,
long ago,
but could not remember
the name of the author.

I had wanted to write
about this subject
of "learned helplessness"
as an explanation
of why no one does anything
to stop the tyranny
which is taking place
right in front of everyone
in this country.

The paper which I had read,
many years ago,
told of the experiments
which were done on a dog
(and later with rats).

The dog was first jolted
with electricity.

As one might expect
the dog would growl,
jump around,
and snap
at it's perceived tormentor/s.

But, each time
that the same jolt was repeated,
over a period of days/weeks,
the dog would resist less and less,
until it finally lay in a quivering mass,
and refused to even fight or growl.

This is the method
which has been used
on numerous detainees

(it is torture,
no matter what name
you may want to call it
in order to avoid the fact
that you are a torturer)

and is being used
on the nation as a whole
so that all are compliant
as they have their
life,
liberty,
and property
stripped away from them,
systematically,
by very evil men
(read neo-Nazis,
neo-Fascists,
crypto-Communists,
and wanna be monarchists).

As I went onto my cell phone
to run a query,
in order to try to locate the paper/s,
now that I had the name of the author,
the first screen which came up
was a news article on Yahoo.

"Putin says nyet",
was the byline.

The story told that Putin
was not going to cooperate
with any extradition request
(or demand, in this case)
coming from the United States,
because he has no extradition treaty
with this country.

So, it was in this context
that I read
one of the most bizarre statements
which I have ever read,
during my entire life.

It was that
our current Secretary of State,
John Kerry
(of Swift boat fame)
was quoted as telling Putin
that he must obey "the rule of law".

In the immediate context
I found that as bizarre
as Hitler saying
the same words
at the height of his
mad quest for
world domination.

"Does this man have any idea
of what the rule of law is?"
I couldn't help thinking to myself
all night long,
as I pondered the question.

Finally at about 4 a.m.,
I couldn't take it any more,
so that I got up
and pulled out a few books
in my legal history library
in order to search
for relevant quotes.

I then went onto the internet
and read a number of papers
which claimed to be telling
the meaning of these words.

It was,
for the most part,
just a bunch of rubbish,
demonstrating no understanding,
whatsoever,
of what the phrase actually means.

As an example,
any number of authors
referred to
the "Code of Hammurabi"
as being the earliest codification
of laws.

An utterly ridiculous statement
highlighting the most profound ignorance,
and telling me
that the author has done
no homework at all
before writing this drivel

(obviously copied from someone else
who knew equally little about
Babylonian history and legal institutions)

which passes for scholarly work.

Why do I say such a thing?

Well, because Hammurabi's stele

(which I stood next to
in the Louvre,
a number of years ago,
as I had my picture taken,
while I pretended to have my arm
wrapped around it,
much to the nervous consternation
of the guard/s,
just as an aside)

is not a codification at all.

There is no such thing
as Hammurabi's Code.

That is a euphemism,
based upon a lack of understanding
of what a legal code is
i.e. a codification of existing law.

Hammurabi's stele
is no such thing.

It is, rather,
a series of precedents,
believed to have been written
for propagandistic purposes
i.e. to justify the authoritarian paternalism
of this oriental despot,
as such have come to be known
in the world of ancient history
and archaeology.

The writings on it deal with cases
(i.e. case law, not codes)
which were presented to the king,
with each example followed by
a sentence telling
how he disposed of each case.

It is the very opposite
of the rule of law,
as you will soon enough find out,
because Hammurabi,
like the Sun King,
after him,
was an autocrat
(oriental despot),
who would be quick
to remind you that
he IS the law.

Hammurabi was a theocratic dictator,
if ever there was one.

He, like all of his predecessors
in this part of the world
(Middle East),
claimed to be
the earthly representative
of deities.

He was known as
"the Shepherd".

And his people
were most definitely
as "sheep to be sheared",
from our modern vantage point.

He is the very thing
that the "rule of law"
is to be distinguished from.

But, I am getting ahead of myself.

Even more basic,
is the fact that it is NOT
the oldest writing of it's kind,
as is so often stated.

Rather,
there are four "codes"
which precede it,
by centuries,
which are Sumerian.

One can find this out
with very little effort
if one were to take the time
to study the subjects
of which one pretends
to be knowledgeable,
while, instead,
showing their ignorance
with every single word
which they write.

In order to define the term
"rule of law"
I must go back
into the history books
just a little bit,
as we consider the role
of the "nation state".

That's right,
for it is here that the term
first begins to have any
meaning and relevance.

Nation states
are a modern invention.

Most people do not realize this.

There were no nation states
prior to modern times.

Before that we had
various different forms of
kingdoms,
theocracies,
autocracies,
oligarchies,
and, above all,
numerous city states.

Even what were termed "republics",
were, in fact,
not modern nation states,
but, rather,
forms of aristocracies,
plutocracies,
and oligarchies.

But, that is another subject,
altogether.

While England may be thought of,
by many,
to have a place in all of this,
it does not.

It is a constitutional monarchy,
(a Germanic tradition,
from which came
our very own
"electoral college" system,
strangely enough)
with a parliamentary system
grafted onto it.

The ancient tribal laws
which preceded it
(Anglo-Saxon laws)
consist of oral tribal customs,
not much different from
the Mosaic law,
which formed the basis for
the Israelitish theocracy.

It was not until the French Revolution
that the problem of
what to do in place of
all of these other systems
really came to the forefront.

Remembering that it was
the consummation of a process
which had been taking place
in Europe
during the several centuries
immediately preceding it
(for example the Swiss republics,
the Venezian republic,
and the Genoan republic
as embryonic forms).

The French Revolution
was ignited by the fact that Louis XIV
(the Sun King)
had been
one of the most autrocratic persons
ever seen in history.

He behaved like an oriental despot
of Hammurabi's time.

"The king IS the law"
was the line which Louis
liked to toss about
as he spent the entire substance
of his once great nation
on his own personal palatial residences
with lots of partying
and continuous wars
which he could not pay for

(who does that sound like,
in this day and age?).

He left his country broke,
and deep in debt

(hmmm, just like
USA today?).

Louis XV and XVI
inherited this terrible state of affairs,
as the country sank into
mass poverty
and mass starvation,
following centuries of greatness.

Once the people
had thrown off the shackles,
by a series of violent revolutions
they were left with
the perennial question of
"what now?".

And it is at this point in history
that a stark contrast
came out in the open
for all to see.

Are we to be ruled
by the whims of an autocrat
who pretends to be
some kind of demigod?

(Ask the male members of
the British Royal family
if their family has claimed
to have the bloodlines
of the warrior god,
Woden,
for example;
the day Wednesday
being
Woden's Day,
just in case
you haven't noticed).

Or are we to be ruled some other way,
by which we,
as peoples,
may become the
masters of our own destiny?

This other way is
"the rule of law".

This is why you will see
"the rule of law"
so often contrasted with
"the rule of men",
meaning the rule of one man,
or one little group of men.

That is to say,
shall we have a man
or group of men
making things up
as we go along,
or are we going to need
something different
and more rational,
if we are to manage our affairs,
which consist of the needs
of millions of persons.

The city of Venice
became one of the most
classic examples of this,
because it stands on the
commercial nexus
of East meets West.

That's a lot of different
kinds of persons
who simply must get along
with one another
if they are to trade goods
successfully.

From these humble
beginnings came
the invention
of the modern nation state,
as the solution to the problem of,
"what now?".

As the French invented
their first elective parliaments
they improvised
and perfected a system
which was based upon
combining together various systems
which had preceded theirs.

Models which proved to be
of particular usefulness,
were the Italian Republics,
like Venezia, Genoa, Firenze, et al,
where various merchants
had worked out arrangements
by which men of many different
nationalities,
cultures,
and beliefs
could work together as one,
in order to facilitate trade
in a way which was
mutually beneficial
to all.

Thus, the "rule of law",
came to stand for a system,
whereby reasonable men
put the best of
their ancient customs
into a written form
and agreed,
by mutual consent,
to abide by such.

This system then advanced,
stage by stage,
from these elementary origins
into the system of nation states,
which we currently use,
while taking for granted
that it has been this way all along.

It most certainly has not.

So long as any system of laws
is promulgated by
and administered by
an autocrat

(i.e. king or equivalent,
and that would include
legislative bodies
which have encroached
upon the executive
to such a degree
as to usurp the
executive function)

THERE SIMPLY IS NO "RULE OF LAW" !!

It is just the SAME system of
the Sun King
("I am the law")
repeated in some other guise.

Now, I should note
in this regard
a couple of matters
which I believe will help
to keep a proper perspective.

In order to do this
I am forced to touch upon
a very deep subject
which is to be
found in
the study of jurisprudence.

It is the argument
of what exactly law is,
in the first place.

There are two main arguments
regarding what law is.

The one doctrine
is known as Jus Naturale
(natural law)
and the other is known as
the doctrine of
positive law.

Natural law is an ancient concept,
which seems to be
often confused with
the "rule of law",
while positive law
is a modern concept,
which pretends to be ancient,
and which has, thereby,
served to return us back,
full circle,
to the autocracies of yesteryear,
only in a modernized form.

The doctrine of natural law
posits that there is a law,
in nature,
which predates anything
which man has made or done.

It is God's law,
in the final analysis.

That is to say,
there is a Creator,
who has created all,
and sustains all.

The Creator is
the ultimate moral authority
and the author of all true law.

This law is thought to be universal,
and knowable by all,
through the use of
their mental faculties
(higher reasoning).

As such, it is discoverable,
by the use of reason,
based upon observation.

The founding fathers,
and William Blackstone,
and Lord Coke, themselves,
took this idea for granted.

It is found enshrined in
those wonderful words
in the Declaration of Independence
in which reference is made
to certain "inalienable rights"
among which are found
the right to
"life,
liberty,
and the pursuit of happiness".

That is to say,
the rights are God-given.

They are our birthright.

Inalienable means
that they cannot be sold
or transferred away.

They are here to stay,
no matter what any
temporal autocrat
or military dictator
has to say about the matter.

Of course,
as people tried to
discuss these matters
with one another,
it was soon enough found
that while I believe
that reason has showed me
one way,
you may believe
that reason has showed you
an entirely different way.

This, unfortunately,
became the fatal flaw
in the system.

Nobody could agree
on just exactly what it was
that reason was telling us.

Add to that
the wide variety of
different religious sects,
following the Reformation,
and one can,
further add all of these thoughts,
to all of the various differing
opinions and ideas
as to what exactly it is
that God is telling us.

For every sect
has a slightly different idea
of what God is,
and what he is saying to them.

As differences exploded
into open warfare
and mass murders
on a grand scale

(1/2 of the younger male population
of the German principalities
being murdered by one another,
in religious wars,
as an extreme example),

it became more and more difficult
to say just what it is
that natural reason is telling us.

Add to that
the invention of Darwinian evolution,
which posits that there is no God,
in the first place,
and one can see
that the natural law ideas
are under severe attack,
as "Social Darwinism"
replaces the principles of
the NT red letters
with "the law of the jungle"

i.e. kill or be killed,
survival of the fittest,
or the craziest,
or the most deranged,
or the most violent,
or the most evil,
as the scum
continuously
rises to the top.
.

So, now the bedrock
principles of natural God-given law
will be
sysematically replaced
with what is known as
"positive law".

That is to say,
the law is
whatever a group of men
say that the law is,
entirely apart from religious beliefs
and considerations.

So, now,
what is essentially
"parliamentarianism",
with all of it's numerous failings
and overreaching

(that is a rather complex matter
for an entire other paper)

begins to encroach
upon the ancient belief systems,
which are actually
supplying the foundation
on which positive law
is resting,
apparently without seeing
the abundant and numerous
contradictions and incongruities
which are thereby created,
and which now become
"the ultimate playground"
for the demagogue
and his/her
all too numerous
enablers and progeny,
as they now have so many
more places to hide behind
as they continue to catabolize
the very fabric of civilization
from the inside out.

So, from about 1830,
until today,
there is
an incredibly dynamic tension
between those
who believe in
a higher moral authority
and those who
deny the existence
of such a thing,
while replacing natural law
with their own system of philosophy,
which they refer to,
very disingenuously
as
"science".

(As if the say that their system
is fact-based,
where that of their opponent's is not
= very misleading use of the term.)

Yet, it can be easily
demonstrated that
it is not science at all
which is being described as such.

First of all,
the ultimate claim
of this pretended science
is that life has arisen
from nonlife.

This is something which has never been observed.

Observation is the first requirement
for something to be a fact,
or a "scientific" fact
(which is redundant,
because science is supposed to
consist of a collection facts).

It is the same with the "big bang" theory.

It has never been observed.

And, indeed, cannot be.

No matter how many postulates
anyone wants to put forth,
which attempt to describe
some person's speculations
all dressed up with
mathematical window dressing.

The foundations
of science are
observation,
measurement,
quantification,
and experimental repetition,
with verification,
none of which is even
remotely possible when
one is speaking of orgins
and ultimates.

It categorically is, rather,
a matter of speculative philosophy,
posing as something
which it simply can never be,
true science

i.e.
it has not ever been observed
(i.e. life from non-life
and the big bang),
it cannot be observed,
it is not measurable,
it is not quantifiable,
it is not experimentally repeatable/verifiable

= these are NOT,
by definition,
facts,
and as such
it fails, altogether,
to qualify as science,

but, rather,

as
"science falsely so-called").

(note: do not allow anyone
to confuse you,
as is so often done,
by substituting change
and adaptation,
which IS found in nature,
and which IS observable,
and quantifiable,
with the ultimate postulate,
of life, arising from non-life,
which is an unproveable, yet,
absolute requirement
for the existence of their system.

The fact that they are claiming
that life arose from non-life,
always remains unspoken,
but always lies, hiding,
back behind all of the jargon,
and fast talk,
and pretended mathematical precision,
which, ultimately turns out to be
nothing more than obfuscation,
all "smoke and mirrors",
in place of hard facts
which can be entered into
the collection of facts,
which is collectively known as
science.)

So, now, we are told
that there is no Creator,
and that "science"
has proved this

(utterly ridiculous nonsense,
for the above reasons

= a modern form of priestcraft,
in the final analysis,
with the lab coat
replacing the priestly garbs
of yesteryear).

So we are now taught
in all of our universities
that it is a matter of
science vs religion,
when in fact it is
one speculative philosophy
vs
another speculative philosophy

i.e. one religion fighting against
another religion,
or anti-religion, if you will,
which becomes just another form of religion,
in spite of all of it's boasts to the contrary.

With the natural corollary of
Darwinian evolutionism
being
that there is no Natural Law,
because
there is no ultimate moral authority
(or being)
upon which to premise such.

This is where
all of the confusion comes from
in the USA today.

For Thomas Jefferson,
a deist,
claims that there are
"inalienable rights"
coming from a deity.

While those who are atheists
are forced to silently deny
that such
is even possible

(atheism is proven,
in their minds,
by their
science falsely co-called,
such that their rationalization
for this brazen behavior is
that they are in possession
of the facts,
while their
opponents are deluded
= OUCH !!)

and must, therefore,
subvert the very constitution
for which they take an oath
to preserve and uphold

(undoubtedly due to their
more enlightened
"higher calling",
as they see it).

Accordingly,
they are forced to
stealthily and dishonestly
build an edifice which
requires that there be
no Creator
on top of a system
which is based upon
the exact opposite premise

i.e. that my ultimate
rights to life, liberty,
and pursuit of happiness
were given to me
by my Creator,
and are, therefore,
inalienable.

One can see that
this is a matter
which is much in need of resolution,
but which is nowhere near
being resolved,
with both camps
having dug in hard
with each refusing
to give any ground,
as each position appears
to be fatal to the other.

NOW,
with regard to positive law,

a number of years ago
I was in the ancient,
little walled town
of Rothenburg by the Tauber (river),
in Bavaria
(modern southern Germany).

Inside those walls
is an incredible three story building
which is known as
"The Criminal Museum".

I first heard of it as
"The Torture Museum".

This museum has collected
numerous medieval torture instruments,
in one of the most bizarre,
and fascinating collections
you will ever see.

I was struck by
a collection of manuscripts
which purport to be
"the law of torture".

Did you even know there was
or could be
such a thing?

I know I sure did not.

I had always thought of torture
as being inherently "lawless",
by it's very nature.

But, such is not the case.

There are numerous huge manuals
which tell exactly how
all of these horrible practices
are to be carried out.

And if you did not abide by
these manuals,
you could become a subject of them,
yourself.

I could not believe the things
which I was reading.

That, my dear friends,
is positive law,
come home with a vengeance.

Only, it was being done
in the name of natural law.

A man made law,
through and through,
but pretending to be
a God-made law.

That is to say,
this dichotomy
of which I am speaking,
is not really anything new,
at all.

But it sure should give you
cause for pause,
when someone is telling you
that you have a duty
to obey laws
because some man,
or group of men
have made them.

Question authority?
or what?

Later on,
I paid a visit to
the first Nazi prison camp,
at Dachau,
which was to become the model
for all which were to follow.

In their little museum
I was shocked to find
some of the same implements of torture
which I had seen
at the Criminal Museum
in Rothenburg.

The ancient
and the modern
forming a very disturbing nexus,
as it were.

Once again,
one would automatically think of
lawlessness.

But one would be entirely wrong,
in so thinking.

For Hitler was,
if nothing else,
the most legally minded person
you are likely to ever have heard of.

He did EVERYTHING by the book!!

He had all of the outward forms of law
and legality,
and did nothing without reference
to this "legal" "system".

He did very little without
numerous legal memorandums
having been written,
just like they do now.

Yet was able
to arrive at the "final solution"
through these very same "legal" means.
and methodologies,
with no problem whatsoever,
once his version of the Patriot Act
(known as The Enabling Act)
was in place.

Therein lies the crux of our problem.

It does not matter
if you are a scrupulous,
law-abiding person,
if the laws are immoral,
through and through.

But, without God,
and religion,
who is to say
what "moral" even is.

And that brings us full circle
to John Kerry.

He wants the dictator,
and ex-KGB officer,
Vladimir Putin,
to obey the "rule of law".

In this case,
that means
sending a man back
to certain death,
in effect,
because he has had the audacity
to expose numerous very serious crimes
on the part of John Kerry
and his Gang of Eight
(in the U.S. Senate),
and their numrous enablers,
and his systems of
secret detention centers
(black sites),
and torture,
which is called
"enhanced interrogation".

This is truly astounding to me,
that John Kerry would dare
to utter such words
such as "rule of law"
while he has willingly
sold his soul for a pittance,
in order to be a player
in the most lawless regime
I have ever seen
or heard of.

But, they claim to be lawful,
just like Hitler did,
and just like
the Medieval torturers did,
and for the exact same reasons.

Do you really believe
that anyone
is actually trying to protect YOU
from terrorists;

the very same ones
which they are trying to arm
with modern advanced weaponry

(Al Qaeda, in this case)

in Syria,
as we speak?

Do you really believe
that Edward Snowden
has a "snowballs chance in Hell"
of getting a fair trial?

Just like Pfc Bradley Manning hasn't,
after having been detained
for years
without charges,
and as he has been tortured
during that time,
according to his attorney
and humans rights observers
who witnessed such?

Do you really believe
that any of these people
abide by any rules of civilization,
when they claim that
the President has the power
to throw citizens in a dark hole,
for as long as he wants
with no power or right
to judicial review?

(I believe that Louis XVI
of France,

and Charles I of England

both claimed this very same power,
didn't they?;

the one bringing on
the storming of the Bastille,
followed by the French Revolution,

and the other bringing on
the first English Revolution,
followed by
The Glorious Revolution,
with Oliver Cromwell's military governance,
providing an interregnum,
just about one hundred years prior to that?)

When I grew up,
during the height of the Cold War,
and immediately following
the numerous revelations
of the atrocities recently committed
by Hitler,
and the Japanese
during WWII,
and those of "the big three" member,
Joseph Stalin,
during the same era,
I was taught that
this is what made us different
from these evil persons.

(note:
"the big three"
were
Winston Churchill,
Joseph Stalin,
and Franklin Roosevelt)

And I was most definitely taught
that they were evil incarnate,
and that it is my responsibility
to see to it that
this never happens again.

But, what has happened,
such that John Kerry
speaks glibly
about some rule of law,
by which he pretends
to have the right and authority
to commit numerous heinous acts
and atrocities far too similar
to the outrages referred to above,
in yours and my names?

As we sit idly by,
having well learned
to be just like that dog
laying on the floor
and shivering.

Unable and unwilling
to do anything more,
as evil men continue
with their non-stop
lawless machinations
to the detriment of
every single creature on the planet.

How long, Oh God,
how long?
is all I can hear my soul asking
about all of this.

And with those observations
you can see why I have insomnia
most of the time

I thought of a couple of more examples
of just how trustworthy these evil men
truly are NOT,
as they can be heard,
very disingenuously,
crying out that
we should just trust them,
as they are only trying
to protect us from their latest
pretended boogeyman.

I read last night about a lawsuit
which is dealing with the fact
that prisoners in Guantanamo
are being kept alive,
by forced tube feeding,
when they do not want to be alive,
and have, accordingly,
stopped eating,
due to the extremely inhumane conditions.

Most of these persons were rounded up
in sweeps of adult male populations.

Yes, It was all widely reported
in the foreign press,
as it was happening,
and I did not miss
the significance of this,
when it happened,
as they surrounded
one town after another
and would only let persons out
who were not fighting age males,
while they trapped the rest
and penned them up in barbed wire enclosures,
like caged animals,
and then threw them into
numerous dungeons,
all around the world,
to be degraded,
humiliated,
and tortured.

Yes, they did this
while your local Amerikan newspapers
told about how we were
winning hearts and minds,
and showed pictures of little kids
being handed candy
by the nice soldier man.

Their crime?

Being fighting age.

No charges have ever been brought.

No charges ever will be brought.

They cannot even provide
probable cause to hold them,
which requires
only the most minimal standards
i.e. a crime has been committed
and I have a reasonable suspicion
that this suspect was involved in it.

The plans are to never release these persons.

Rule of law?

You've got to be kidding !!

They are only being kept alive
to continue to torment them.

And for those who have never
worked in a long care medical setting,
you have no idea just how disgusting
of an idea this really and truly is.

You definitely do not want to be
the person having the tube
stuck up their nose,
or down their throat,
for longer than a few hours.

If this is not torture,
then what exactly is?

I'll bet if someone was doing this
to John McCain,
or his children,
or Hillary Clinton
and her family,
or Barry O.
and his family,
their lawyers would argue,
forcefully, and strongly,
that this IS torture.

If they didn't
their competency
would seriously be
called into question.

And rightfully so.

Especially if it was being done
by the Chinese or the Russians.

The hypocrisy is truly astounding.

And I am supposed to trust such persons?

Ain't no way !!

And what about the suspect
who was waterboarded over 180 times,
and still could not
and would not
admit to having anything
to do with the bringing down
of the World Trade Center towers?

(remember this was all recorded,
and then the tapes were all destroyed,
"inadvertently",
it was claimed,
by one bad egg,
but of course,
with no repercussions
to any of the criminals
who took part in the
destruction of this
very important evidence.

Wouldn't YOU like to know
just what this person said,
180 times in a row,
instead of "I did it";
must be especially interesting,
or should I say, damaging,
given that some persons
went through so much trouble
to cause the destruction of this
very imporant evidence?)

Not torture?

Yet, any number of Japanese
were condemned to death
for this very same
crime against humanity
following WWII.

A polic chief,
in the USA,
was given
a very long sentence in prison
for doing the same.

What is wrong with these people?

And what is wrong with those
who follow right along
as if all is normal
and nothing is happening here?

Strong delusion, anyone?

Right out of the Book of Revelation.

Finally, I wanted to apologize,
at least a little,
for being so hard on those
who don't know their Babylonian legal history,
and yet pretend to.

I know that I sound a little bit shrill,
or maybe even pedantic,
in so saying.

But, the reason for this
has nothing to do with
legal history, as such.

It is because they were trying to use
this
as an example of man's
pretended eternal quest
to make laws to protect one another.

In that context
this couldn't be more ridiculous.

Let me explain to you
what happens when you seek an audience
with these "great"
Middle Eastern monarchs
of yesteryear.

You lay down on your belly,
prostrating yourself in front of
the "oh, great king",
then a man puts his foot
on your neck
and shoves it hard
into the floor.

Then he raises a huge sword
over your head,
and looks to the king
to tell him whether to chop your head off,
or not.

Finally, if you are fortunate enough
to get to speak,
the king will ask you,

"And what was your problem, exactly?"

This legal counselor
would counsel you
to choose your words
very carefully.

Clearly this kind of person
has nothing to do
with the "rule of law".

And the fact that somebody
wrote out some legal precedents
for purely political propagandistic
purposes has very little to do
with the rule of law.

In fact,
it stands for
the diametric opposite.

Yet, a quick perusal
of all of the various articles
on the internet
can only make you wonder
whether everyone is copying everyone else,
as they all tell how Hammurabi's "Code"
is somehow an early formulation
of the "rule of law".

That couldn't be more absurd,
in light of the well known facts of history,
and yet I saw it
over and over again.

That is why I was so irritated
with the lack of homework
on the part of the writers
(or plagiarists?)
of these articles,
which pass for modern scholarship.

Please forgive me
if I seem too bitter.

I really am not.

But I must admit
to having been particularly irritated
by that one.

I think if you will take some time
to consider the matters to which I have
drawn your attention, above,
you will better understand
just exactly what it is
that I am talking about, here .
